Based upon the Decree of the Presidency of the Presidium of the National Assembly of the People’s Federal Republic of Yugoslavia Adm. No. 392 from 8 March 1947 with which the Government of the FNRJ was entrusted to fulfil the decision of taking away the citizenship of FNRJ and entire assets of the members of the Karageorgevich family, the Government of the FNRJ hereby brings the following

 

O R D E R:

 

By the Decree of the Presidency of the Presidium of the National Assembly of the People’s Federal Republic of Yugoslavia Adm. No. 392 from 8 March 1947 (Official Gazette No. 64 from 1 August 1947) from the Karageorgevich family, the FNRJ citizenship is taken away and the entire assets have been confiscated from the members of the Karageorgevich family.

For this, it is necessary that amenable Canton Courts conduct the confiscation of assets on their territory; therefore the Ministry of Justice of the People’s Federal Republic of Yugoslavia is called to emit necessary instructions to the Courts which will, on behalf of Article 14 Paragraph 3 of the Confiscation Law, start up the process and transmit assets to the bodies which will administer such assets.

In implementation of confiscation, it is directed to attention that debts of the confiscated property are, without a doubt, smaller than the assets themselves, therefore procedure of evaluation of confiscated assets by the Decree of Valuation of Confiscated Assets, Assets of the German Reich and German Citizens, and of Debt Liquidation and Asset Claim, but only the potential validation of importance of some assets claims in relation to the confiscated property, which will be in charge of the Ministry of Finance of the People’s Federal Republic of Yugoslavia.

It is from here onwards directed to attention that this confiscation also includes assets that today are still the property of Alexander I Karageorgevich, considering that the Decision of the Canton Court of the City of Belgrade No. 428/34 from 27 October 1938 that Peter, Tomislav and Andrei Karageorgevich are set as inheritors of these assets.

The Courts that will conduct the confiscation of assets and the state bodies appointed by the Government of the FNRJ to administer the assets, i.e. the state bodies entrusted by the Government of the FNRJ to appoint administrative bodies, are the following:

1) Canton Court of Oplenac Canton:

            a) power station in cadastral municipality Topola on the name of Alexander I Karageorgevich, possession document No. 105, mortgage registration lot document No. 1;

            b) administrative body – Sumadija Electricity Company of Serbia under administrative and operating management of General          Directorate  for Electric Power Industry of Serbia

2) Canton Court of Oplenac Canton:

            a) Karageorge Canton Hospital in cadastral municipality Topola on the name of Alexander I Karageorgevich, possession document No. 105, mortgage registration document No. 1, lot 73;

            b) administrative body – People’s Board of Oplenac Canton

3) Canton Court of Oplenac Canton:

            a) old Karageorge’s Residence in cadastral municipality Topola on the name of Alexander I Karageorgevich, possession document No. 105, mortgage registration document No. 1, lot 484/2;

            b) administrative body– People’s Board of Oplenac Canton

4) Canton Court of Oplenac Canton:

            a) First Serbian Military Barrack in cadastral municipality Topola on the name of Alexander I Karageorgevich, possession document No. 105, mortgage registration document No. 1, lot 473;

5) Canton Court of Soko Banja Canton:

            a) King’s prairies in cadastral municipality Soko Banja as legacy of Alexander I Karageorgevich, possession document No. 794

            a) Dedinje Palaces and White Palace in cadastral municipality Belgrade 7 on the name of Peter, Tomislav and Andrei Karageorgevich, possession document No. 82, 86 and 189 in 9 lots

7) Canton Court of Belgrade City Canton:

            a) Royal garden Rakovica in cadastral municipality Belgrade 6 on the name of Peter, Tomislav and Andrei Karageorgevich, possession document No. 795, lot 3854;

a) Factory for gold mine refining in Glogovica, as a part of the Neresnica-Glogovica Mine Company on the name of Alexander I Karageorgevich;

b) administrative body– Management of Gold Mines in Pek under administrative and operational management of General Directorate of coloured metals of the Ministry of Mining of the FNRJ

28) Canton Court of Zviski Canton in Kucevo:

a)         1) laboratory for gold refining Neresnica

            2) dredger in river Peka

            3) Brodica, mine for gold extraction

            4) Zeleznik, mine for gold extraction, as part of the Neresnica-Glogovica Mine Company on the name of Alexander I Karageorgevich;

b) administrative body– Management of Gold Mines in Pek under administrative and operational management of General Directorate of coloured metals of the Ministry of Mining of the FNRJ.

 

29) Canton Court of Zviski Canton in Kucevo:

a)         1) Radenka, coal gas pit of lignite

                2) Sevica, coal gas pit of lignite as part of Mine Company Neresnica-Glogovica on the name of Alexander I Karageorgevich;

b) administrative body will be determined by the Government of the People’s Republic of Serbia

            a) Savings cards, bonds, shares, foreign currency, crate of valuables number 23 and other valuables – on safe keeping at the Receivership of King’s Goods, National Bank of the FNRJ

            b) administrative body – National library under authority of Ministry of Education of the People’s Republic of Serbia.

When determining the state bodies which will administer assets, the following have been taken into account - present conditions, needs of the Federal and Republic’s bodies, the purpose of the assets, as well as regulations of the Decree of the Presidium of the National Assembly of the FNRJ regarding determining of Federal bodies for the buildings in state property.

All Federal organs which are administrating parts of these assets are called upon to immediately address authorized Canton Courts and to give them all necessary data regarding the executing of confiscation and transfer of assets.

Governments of People’s Republics are kindly asked to determine their Republic’s bodies which will administer parts of confiscated assets, if they are not already determined, and to call on all state bodies in their districts which administer parts of these assets or administration will be determined to them, to address relevant Canton Courts regarding the executing of confiscation and transfer of assets.

All state bodies will inform the Presidency of the Government of the FNRJ about the completed confiscation and transfer of assets.

Data of claims and debts of the confiscated mass shall be surrendered to the Ministry of Finance of the FNRJ by the Receivership of King’s Goods.

The Ministry of Finance of the FNRJ will take care of liquidation of the Neresnica-Glogovica Mine Company.

The Receivership of King’s Goods, after it surrenders parts of the assets that it manages today to the determined state bodies, as well as the data on claims and debts of this property will cease to exist, after which it will inform the Presidency of the Government of the FNRJ.

This confiscation does not include the agricultural estate of Oplenac together will all buildings and inventory, which is today managed by the Presidency of the Government of the People’s Republic of Serbia, since this is a part of the Foundation of St. George at Oplenac, so the Presidency of the Government of Serbia is consigned to act on behalf of Agricultural Reform and Colonization Law.

The Ministry of Internal Affairs of the FNRJ will execute the Decision of the Presidium of the National Assembly of the FNRJ about the citizenship record keeping.

The following should be informed about this: Presidency of the Presidium of National Assembly of the FNRJ, Ministry of People’s Defence of the FNRJ, Ministry of Internal Affairs of the FNRJ, Ministry of Finance of the FNRJ, Presidency of the Government of the FNRJ, General Department, Presidency of the Government of the People’s Republic of Serbia, Presidency of the Government of the People’s Republic of Slovenia, Presidency of the Government of the People’s Republic of Montenegro, Presidency of the Government of the People’s Republic of Macedonia and the Receivership of King’s Goods.
